USCIS Form I-9
For employment in the United States, Form I-9 is used to verify the identity and employment authorization of the individual. All U.S. employers must complete Form I-9 correctly for each individual they hire to work in the United States.
The I-9 form may be obtained through Gusto's onboarding process. It should be used if an employee has not completed it through Gusto. However, if you hire an employee and backdate their actual start date it will NOT generate the I9 and you will need to provide a physical copy for the employee to complete.

W-4 Form
The IRS W-4 form lets the employer know how much to withhold from the employee’s check for federal taxes. Correctly completing the W-4 can help the employee avoid having a big balance due at tax time.

Time of Hire/Worker's Compensation
California law requires all employers to provide each new employee a written notice of their rights, benefits, and obligations under the California Workers’ Compensation Law either when they are hired or by the end of their first pay period. The Time of Hire Workers’ Compensation Pamphlet has been approved by the Division of Workers’ Compensation to fulfill the employer’s notification requirement.
The pamphlet explains:
- worker's compensation
- the benefits of workers’ compensation in California
- where to obtain assistance with problems
- current total disability, permanent disability, and death benefit rates
- discrimination related to filing a claim, having the claim settled, or providing testimony
- obtaining medical care, Medical Provider Networks (MPN), and pre-designation of a personal physician
- physician pre-designation form
- a chiropractor or personal acupuncturist pre-designation form
Facts About Sexual Harassment (Form DFEH 185)
Sexual harassment refers to discrimination based on sex or gender (ex: pregnancy, childbirth, or medical conditions related to those conditions), gender identity, or sexual orientation. Anyone can be subjected to sexual harassment, regardless of their gender. It is not necessary to have an ulterior motive to commit unlawful sexual harassment.
Disability Insurance Pamphlet (EDD Form DE 2515)
The term disability refers to the inability to perform customary work as a result of a physical or mental disability. Medical conditions associated with surgery, pregnancy, and childbirth are considered disabilities.
In addition to the State Disability Insurance (SDI) program, Disability Insurance (DI) is a separate program, with the purpose of replacing wages lost due to a non-work-related disability.
Paid Family Leave Brochure (EDD Form DE 2511)
Working Californians often find it difficult to find time for their loved ones when they need it the most. California's Paid Family Leave program was developed to help families in these difficult times. You may receive benefits if you are caring for a seriously ill family member, bonding with a new child, or participating in a qualifying military event.
Report of New Employee(s) (EDD Form DE 34)
Every California employer who hires a new employee or rehires an existing employee must report them to the New Employee Registry within 20 days of their start date, or the day they begin work. It is also mandatory to report employees who have been rehired within 20 days of leaving after 60 consecutive days.
This is handled by our payroll provider. It's ONLY for reference, so we don't have to file it or provide it to the employee.
Form LC 2810.5 Notice to Employee (nonexempt employees)
Labor Code 2810.5 is aimed at informing employees about such fundamental and material information concerning their pay and rates of pay under an employment relationship.
The hiring manager MUST complete this form and have the employee sign the document and upload this into our payroll platform. This should only be presented to non-exempt employees.

Policy Against Discrimination and Harassment
ACA- Affordable Care Act Notification
This form must be given to the employee within 14 days of hire/ Please complete the second age of the form and submit it to the employee and keep one in their employee file.
DE 4 EDD Employee’s Withholding Allowance Certificate
The employee will complete this on the Gusto/payroll provider platform, but should also complete the manual form and submit it to the hiring manager.
